Terms and Conditions of Rainbow Mountain Expeditions
Welcome to Rainbow Mountain Expeditions. These terms and conditions outline the guidelines for the use of our travel agency services. By using our services, you agree to the terms and conditions described below. We recommend reading this document carefully.
1 – Reservations and Confirmations:
(1) Reservations: Reservations can be made through our website or direct contact. By making a reservation, you confirm that the provided information is accurate and complete.
(2) Confirmations: Booking confirmations will be sent via email. It is your responsibility to review the information and notify us of any errors or discrepancies immediately.
2 – Payments and Cancellations:
(1) Payments: Payments are made according to the rates and conditions set in the booking process. We reserve the right to withhold services until receiving full payment (the final tour payment is made one day before the preferred tour date at our office in cash).
(2) Cancellations: Cancellation policies vary depending on the type of service booked. We recommend reviewing the specific conditions at the time of booking.
3 – Traveler’s Responsibilities:
(1) Documentation: It is the traveler’s responsibility to ensure they have the necessary documentation for the trip, such as passports and visas.
4 – Changes in Itineraries and Tour Date Changes:
(1) Modifications: We reserve the right to make changes to itineraries, dates, or services due to weather conditions, force majeure circumstances beyond Rainbow Mountain Expeditions’ control, including but not limited to acts of God, civil or military disturbances, extreme weather, illnesses, technological disruptions, labor strikes, or acts of war or terrorism. The Customer acknowledges that Rainbow Mountain Expeditions may need to modify or even cancel a trip in response to a force majeure event and will not be responsible for such alteration or cancellation.
5 – Liability and Travel Insurance:
(1) Travel Insurance: We strongly recommend obtaining travel insurance covering cancellations, luggage loss, and medical assistance.
(2) Liability: Rainbow Mountain Expeditions is not liable for losses, damages, injuries, or expenses resulting from circumstances beyond our control.
(3) Notification in Case of Serious Incidents: Before booking the tour, the customer must notify us if they suffer from any illnesses related to heart or mind problems. Failure to do so is at their own risk in the event of incidents such as decompensation or, in some cases, severe outcomes like death. In the unfortunate event of an accident or death during our services, the customer or their representatives must notify Rainbow Mountain Expeditions immediately. Additionally, the customer commits to being in good health and suitable physical condition for the activities.
(4) Collaboration in Emergency Situations: The customer agrees to fully cooperate with local authorities and Rainbow Mountain Expeditions in managing emergency situations, including following the instructions of agency staff and competent authorities.
(5) Financial Responsibility: The customer assumes financial responsibility for any additional expenses related to emergency medical services, evacuation, or other services associated with critical situations. This includes, but is not limited to, medical costs, emergency transportation, and additional accommodation.
(6) Mandatory Travel Insurance: It is mandatory for the customer to have travel insurance covering emergency medical situations and evacuation. Rainbow Mountain Expeditions is not responsible for costs associated with medical emergencies or expenses incurred due to the absence of adequate travel insurance.
6 – Traveler’s Behavior:
(1) Proper Conduct: We expect travelers to maintain respectful and considerate behavior towards other participants, staff, and local communities.
7 – Data Protection:
(1) Privacy: The collection and management of personal data are governed by our privacy policy. By using our services, you agree to our privacy practices.
8 – General Provisions:
(1) Jurisdiction: These terms and conditions are governed by the laws of the Republic of Peru, and any dispute will be submitted to the jurisdiction of the Commercial Courts of Lima, Republic of Peru.
(2) Modifications: We reserve the right to update these terms and conditions. Modifications will take effect immediately upon being published on our website.
